1. Service Description
True46 ("the Service") is a consumer genomic wellness platform that analyzes raw genotype data files from 23andMe and AncestryDNA. The Service processes your uploaded genetic data through a multi-phase analysis pipeline and generates a personalized health report covering nutrigenomics, pharmacogenomics, polygenic risk scores, and lifestyle recommendations.
By accessing or using the Service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
2. Not Medical Advice
The Service is an educational and informational tool only. It is not a medical device, diagnostic service, or clinical laboratory. Reports generated by True46 do not constitute medical advice, diagnosis, or treatment recommendations.
You should:
- Consult a qualified healthcare provider before making any medical decisions based on your report
- Not use report results to self-diagnose, self-treat, or replace professional medical guidance
- Discuss any pharmacogenomic findings with your physician or pharmacist before altering medication regimens
- Understand that polygenic risk scores indicate statistical tendencies, not certainties
3. Genetic Data Handling
When you upload a genetic data file:
- Your raw genotype file is stored temporarily in our database for processing
- An automated pipeline analyzes your data across 46+ analysis phases
- After processing is complete, the raw genotype data is permanently deleted from our systems
- Only the curated analysis results (the report data) are retained

4. Data Retention
- Reports automatically expire and become inaccessible 30 days after generation. Expired report data is periodically purged from our systems.
- Share links expire 7 days after creation
- You may request earlier deletion of your report data at any time by contacting us
- Once a report expires or is deleted, it cannot be recovered — you would need to upload your data again
5. Accuracy Limitations
You acknowledge and understand that:
- Consumer genotyping uses SNP microarray technology, which is different from and less comprehensive than clinical-grade whole genome sequencing or targeted panels
- Polygenic risk scores (PRS) are calibrated primarily on European-ancestry reference cohorts and may be less accurate for individuals of other ancestries
- Variant interpretation depends on current scientific literature, which evolves over time
- AI-generated interpretations, while grounded in published research, may contain errors or omissions
- The Service does not detect all genetic variants and cannot identify structural variants, copy number changes, or epigenetic modifications
6. Prohibited Uses
You agree not to use the Service or any information obtained from it for:
- Insurance decisions — using genetic results to make, influence, or deny insurance coverage decisions for yourself or others
- Employment decisions — using genetic information in hiring, firing, promotion, or other employment actions
- Forensic or legal identification — using the Service for forensic analysis, legal proceedings, or identifying third parties
- Discrimination — any use that would violate the Genetic Information Nondiscrimination Act (GINA) or similar laws
- Unauthorized access — uploading genetic data belonging to another person without their informed consent
7. Intellectual Property
The analysis pipeline, report templates, curation algorithms, and AI interpretation architecture are proprietary to True46. You receive a personal, non-transferable license to view and download your report for personal use. You may not reproduce, reverse-engineer, or commercially redistribute the analysis methodology or report format.
Your genetic data remains yours. We claim no ownership of your raw genotype data or the underlying genetic information contained therein.
8. Limitation of Liability
To the maximum extent permitted by applicable law:
- The Service is provided "as is" and "as available" without warranties of any kind, express or implied
- True46 shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service
- Our total liability for any claim related to the Service shall not exceed the amount you paid for the report in question
- We are not liable for any health outcomes, medical decisions, or actions taken based on report content
9. Account Responsibilities
You are responsible for maintaining the confidentiality of your report access link and any share links you generate. Anyone with your report URL can view your genetic analysis. Do not share your report link with untrusted parties.
10. Changes to Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms. For material changes, we will make reasonable efforts to notify affected users.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the state and federal courts located in Delaware.
